  • "Creem" means our third-party payment processor used to process payments and manage subscriptions.

These Terms govern Your use of the Service. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree to any part of these Terms, please do not use the Service.

Your use of the Service is also subject to Our Privacy Policy, which explains how We collect and use Your data.

User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

Service Functionality

thumbnail-maker is a web-based service that helps you create video thumbnails by:

  • Analyzing the Content you provide (such as images, videos, and text inputs)
  • Generating Output (such as thumbnail images, layouts, and creative suggestions) using AI and other algorithms

Acceptable Use and Prohibited Activities

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe or violate the intellectual property, privacy, or other rights of others.
  • Upload Content that you do not have the right to use, or that contains illegal, harmful, or misleading material.
  • Interfere with or disrupt the Service or attempt to bypass rate limits, access controls, or security measures.
  • Reverse engineer, decompile, tamper with, or attempt to extract the source code of the Service, except where such restriction is prohibited by law.
  • Use the Service to distribute malware or to engage in phishing, spamming, or abusive behavior.
  • Harass, abuse, or harm other individuals or entities.
  • Create multiple accounts or otherwise circumvent usage limits or pricing restrictions.

Intellectual Property

All intellectual property rights in the Service (excluding your Content and Output), including software, design, and website content, are owned by the Company or its licensors. You may not copy, modify, or distribute any part of the Service without our prior written permission.

License Grant

We grant You a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

Your Content

You retain ownership of your Content. You grant us a limited license to host, reproduce, process, transmit, and display your Content solely to provide, maintain, and improve the Service, including sending Content to third-party AI providers as necessary to generate Output.

You represent and warrant that you have all rights necessary to provide your Content and to grant the rights described in these Terms.

Output Ownership

As between you and us, you own the Output generated for you through the Service, to the extent permitted by applicable law.

You are responsible for ensuring that your use of the Output complies with applicable laws and does not infringe the rights of any third party. Similar or identical Output may be generated for other users due to the nature of AI systems.

No Storage of Uploads (Operational Processing)

The Service may process your uploaded images and videos to generate Output. We do not intentionally store your uploaded images/videos as persistent user content. However, we may temporarily process or cache Content and Output to operate the Service (for example, to complete requests, prevent abuse, ensure reliability, or comply with legal obligations), as described in our Privacy Policy.

Free and Paid Features

The Service offers both free and paid features:

  • Free users have access to basic functionality with certain limitations.
  • Paid subscriptions provide access to advanced features and higher usage limits.
  • Pricing and feature availability are subject to change at Our discretion.
  • Subscription fees are charged in advance on a recurring basis (monthly or annually).
  • You may cancel Your subscription at any time, with cancellation taking effect at the end of Your current billing period.
  • Refunds, if any, are handled in accordance with the purchase flow, any posted refund policy, and/or as required by law.

Payments and subscription management are processed by Creem and may be subject to Creem's terms.

Data Privacy

We collect and use personal information as described in our Privacy Policy. For example, we process account information, usage data, and Content submitted to generate Output. We may share limited information with third-party service providers (including AI providers and Creem) to operate the Service.

Third-Party Services

The Service may integrate with third-party services (including AI services) to provide functionality. Use of third-party services may be subject to their respective terms and privacy policies. We are not responsible for third-party services.

Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, if we believe your use poses a security risk, or to comply with law. You may stop using the Service at any time.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to Your use of the Service, including but not limited to:

  • Any loss of profits, revenue, or business opportunities
  • Any outcomes related to performance of thumbnails (including click-through rate or views), which are not guaranteed
  • Any technical issues or service interruptions

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law principles.

Changes to Terms

We may update these Terms at Our discretion. We will notify Users of any material changes via the Service, email, or other communication channels. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
